The Fair Work Legislation Amendment (Closing Loopholes) Act
2023 has amended the Fair Work Act 2009 (FW Act) to provide specific rights and
protections for workplace delegates in representing certain employees in the
workplace.
Whilst protections for workplace delegates’ rights are not
new, what is new is a codification of such rights being set out in detail in
the FW Act and extending the general protections regime to them.
This guide is intended to help employers navigate the recent
changes and offer practical advice for complying with new obligations. It is
important that employers familiarise themselves with these changes,
particularly given the potential ramifications of not complying with the
changes.
